Notifiable occupational diseases (Factories Act, Third Schedule)
When a worker contracts any of these diseases, the factory manager must send notice in Form 27 to the Chief Inspector of Factories and the Certifying Surgeon.
Statutory basis: Third Schedule to Section 89, Factories Act 1948 + Schedule to Rule 122 (Notice of Poisoning or Disease)
The Third Schedule to Section 89 of the Factories Act 1948 lists the occupational diseases that are notifiable — a medical practitioner or the factory who becomes aware of a case has a duty to report it.
- Lead poisoning, including poisoning by any preparation of lead or their sequelae
- Lead tetra-ethyl poisoning
- Phosphorous poisoning or its sequelae
- Mercury poisoning or its sequelae
- Manganese poisoning or its sequelae
- Arsenic poisoning or its sequelae
- Poisoning by nitrous fumes
- Carbon disulphide poisoning
- Benzene poisoning (including by homologues, nitro/amide derivatives or sequelae)
- Chrome ulceration or its sequelae
- Anthrax
- Silicosis
- Poisoning by halogen derivatives of hydrocarbons of the aliphatic series
- Pathological manifestations due to radium / radio-active substances; and X-rays
- Primary epitheliomatous cancer of skin
- Toxic anaemia
- Toxic jaundice due to poisonous substances
- Oil acne or dermatitis due to mineral oils + compounds containing mineral oil base
- Byssinosis
- Asbestosis
- Occupational / contact dermatitis (primary irritants + allergic sensitizers)
- Noise-induced hearing loss (exposure to high noise levels)
Manager must send notice in Form 27 to BOTH the Chief Inspector and the Certifying Surgeon. (Section 89; Rule 122)
