These Terms of Use ("Terms") govern your access to and use of the MedFactory platform and website (the "Service"), an independent goodwill initiative for Factory Medical Officers, built and maintained by practising occupational-health doctors. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

The Service is intended for use by qualified Occupational Health Centre, medical, safety and HR professionals, and by factory occupiers/management, in connection with statutory occupational-health record-keeping.
You are responsible for the accuracy of the information in your account and for keeping your login PIN confidential. You are responsible for all activity under your account.

2. Licence & acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You agree not to:

use the Service unlawfully, or to process data you are not authorised to process;
attempt to breach security, reverse-engineer, scrape, or disrupt the Service;
upload unlawful, infringing or malicious content; or
misrepresent statutory records or use the Service to facilitate non-compliance.

3. Your responsibilities for data

You must obtain the consents and authorisations required to enter worker/employee personal and health data, and to process it lawfully.
You are responsible for the correctness and completeness of records you create, and for verifying any auto-generated or sample content before relying on it.

4. Medical & statutory disclaimer

MedFactory is a record-keeping and workflow tool. It is not a medical device, and it does not provide medical advice, diagnosis, treatment, or legal advice. It is not a substitute for the professional clinical judgment of a registered medical practitioner or for independent legal/compliance advice.

Statutory thresholds, forms and reference information are provided as aids and may not reflect every applicable central or state rule, amendment, or local interpretation. You remain solely responsible for your statutory compliance and clinical decisions. Sample/demo data is clearly marked and must never be relied upon as real records.

5. Intellectual property

The Service, its software, design and content (excluding the data you enter) are owned by MedFactory and protected by law. These Terms grant you no ownership in the Service.

6. Availability

We aim to keep the Service available but provide it on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the extent permitted by law. We may modify, suspend or discontinue features.

7. Limitation of liability

To the maximum extent permitted by law, MedFactory shall not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits, or statutory penalties, arising out of or relating to your use of (or inability to use) the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

8. Indemnity

You agree to indemnify and hold harmless MedFactory from claims arising out of your misuse of the Service, your breach of these Terms, or your unlawful processing of data.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or where required by law. Statutory records retention obligations survive termination.

10. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts of competent jurisdiction in India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
